Solution
As long as the licensing model uses a license key (fpmkey.txt) rather than a Registration Code, there is no problem using the fpmkey.txt in both persistent and non-persistent images. The license key does not keep a continuous use count or contact a server to be activated. A VM can be created, destroyed, and cloned without worry about Foxit PhantomPDF licensing problems.
Note: a Registration Code does not work well in VMs.
